It may be hard to imagine a time in our lives when we are no longer able to care for ourselves, and make critical decisions about our medical needs and finances.
A valid Enduring Power of Attorney allows a trusted individual to exercise authority when your capacity is limited, or you are entirely incapable of dealing with your financial affairs.
A Representation Agreement allows a trusted individual to exercise legal authority over your health and personal care - should you be unable to do so for yourself. A Representation Agreement also allows you to set out any healthcare wishes that you would like honoured in the event that you can no longer communicate these wishes yourself.
Unfortunately, many individuals wait too long before putting their wishes in writing, and once mental capacity is impaired, the opportunity to do so is lost.
The cost of not having an Enduring Power of Attorney or a Representation Agreement is much higher than the cost of preparing these documents. A few hundred dollars spent on Personal Planning now, can save you and your loved ones many thousands of dollars in the future.
Do you have a plan to protect your real estate and other assets after your death? Have you contemplated the guardianship of your children?
A well-crafted and accurate Will is the only way to ensure that, upon your death, your wealth will be distributed the way you had intended, and that your children have the care that you wish for them.
Every adult who owns assets, has a spouse or children, should have a properly drafted and executed Last Will. If you don't have a Will (and pass Intestate), important decisions about your property and guardianship of your children, will be made for you. Your beneficiaries may even waste part of your Estate in litigation.
Disputed Wills / Inheritance Litigation
